Entries 121 through 134 run from September 29 to October 28, 2026. ARB Gaming LLC filed its notice of the arbitration award (ECF 121). Affirm, Inc. requested leave to file a responsive brief to the plaintiff’s opposition to the ECF 111 minute order (ECF 122); the plaintiff requested reconsideration of the ECF 116 minute order (ECF 123) and responded to Affirm’s request (ECF 124). Counsel for the plaintiff-in-interpleader filed a notice of errata to her contact information (ECF 125). The plaintiff moved for an order directing ARB Gaming to preserve arbitration records and for leave to serve a subpoena on JAMS (ECF 126), and asked to appear remotely at the November 3 hearing (ECF 129), with certificates of service (ECF 130, 131). Minute orders granted both sides’ requests on the Affirm briefing (ECF 127), denied the preservation motion and the subpoena request and vacated the November 3 hearing (ECF 128), and denied the remote-appearance request as moot (ECF 132). Affirm, Inc. filed a notice terminating attorney Ryan Lewis as counsel (ECF 133), and the plaintiff filed a supplemental brief regarding the notice of final arbitration award (ECF 134).

(ECF No. 111). Plaintiff also requests leave to file a reply if Defendant Affirm, Inc.'s responsive brief is accepted. (ECF No. 124 .) The parties have already filed their proposed briefs. (ECF No. [122-1]; ECF No. 124, Exh. A.) Both Defendant Affirm, Inc.'s and Plaintiff's requests are GRANTED. The Courts accepts Defendant Affirm, Inc.'s Response to Plaintiff's Opposition to Notice of Intent toDismiss as filed at ECF No. [122-1], and the Court accepts Plaintiff's Reply to Defendant Affirm, Inc.'s Responsive Brief as filed at ECF No. 124, Exhibit A. MINUTE ORDER issued by Relief Courtroom Deputy for Magistrate Judge Chi Soo Kim on 10/14/2026: The Court is in receipt of Plaintiff's motion for an order (1) directing Defendant ARB Gaming LLC to preserve documents and (2) granting leave for Plaintiff to serve a subpoena on JAMS. (ECF No. 126 .) A preservation order is not necessary because Plaintiff has not shown good cause to believe that Defendant ARB Gaming LLC will fail to comply with its obligations to preserve documents in this litigation. See Wheeler v. Aliceson, 2015 WL 3507369, at *6 (E.D. Cal. June 3, 2015) ("The duty to preserve evidence, backed by the court's inherent power to impose sanctions for the destruction of such evidence, is sufficient in most cases to secure the preservation of relevant evidence.") (citation modified). Accordingly, Plaintiff's request for a preservation order as to Defendant ARB Gaming LLC is DENIED. Further, Plaintiff's request for leave to serve a subpoena on JAMS is DENIED because Plaintiff has not shown good cause to engage in discovery before the parties have conferred as required by Rule 26(f) and where multiple motions to dismiss and compel arbitration are still pending before the Court. See Kulkarni v. Upasani, 659 F. App'x 937, 941 (9th Cir. 2016) ("It was not an abuse of discretion for the Magistrate Judge to determine that... [Plaintiff] had not established good cause for why discovery must occur before disposition of the motions to dismiss and strike."). The November 3, 2026 hearing on Plaintiff's motion is VACATED. IT IS SO ORDERED. (TEXT ONLY ENTRY) (Deputy Clerk CRN) (Entered: 10/14/2026)
