MINUTE ORDER issued by Relief Courtroom Deputy for Magistrate Judge Chi Soo Kim on 8/3/2026: On July 21, 2026, Plaintiff-in-Interpleader Jamie Stahura filed a motion to withdraw as counsel. (ECF No. 88 .) The docket entry text states: "Motion Hearing set for 8/5/2026 at 10:00 AM in Bakersfield (CDB) before District Judge Daniel J. Calabretta." Id. On August 3, 2026, counsel for Plaintiff-in-Interpleader contacted the Court and stated that they had intended to notice a hearing on August 5, 2026 before Magistrate Judge Chi Soo Kim in Courtroom 25. However, Plaintiff-in-Interpleader's motion was not properly noticed for hearing before Judge Kim or noticed on a date designated for the Court's civil law and motion calendar, and counsel did not provide notice to the Court of their docketing error until two days before the intended hearing date. Accordingly, no hearing on Plaintiff-in-Interpleader's motion to withdraw has been set. The motion will be submitted for decision on the record and written briefing pursuant to Local Rule 230(g). Within seven (7) days of this order, Plaintiff is ordered to separately file his supplemental brief already submitted to the court (ECF No. 109 at 115-119) together with his supplemental declaration. The Court is providing notice to Plaintiff that it may sua sponte dismiss certain claims against Defendant Affirm, Inc., namely, (1) unfair business practices in violation of California Business & Professions Code § 17200 (Count Six); (2) unjust enrichment (Count Seven); (3) "payment processor liability" (Count Eleven); and (4) aiding and abetting (Count Twelve) for failure to state a claim pursuant to Federal Rule of Civil Procedure 12(b)(6), see Wong v. Bell, 642 F.2d 359, 362 (9th Cir. 1981), to the extent these claims against Defendant Affirm, Inc. are barred by California's public policy against judicial resolution of gambling-related claims. See In re Apple Inc. App Store Simulated Casino-Style Games Litig., 806 F. Supp. 3d 1015, 1034-35 (N.D. Cal. 2025), appeal docketed, No. 25-7917 (9th Cir. Dec. 17, 2025). Plaintiff will be afforded an opportunity to respond by submitting a written opposition within thirty (30) days from the date of this order. See Wong, 642 F.2d at 362. Plaintiff is warned that failure to file an opposition by the prescribed deadline may result in a recommendation that Plaintiff's claims be dismissed without leave to amend. Thereafter, the motion will be submitted for decision on the record and written briefing pursuant to Local Rule 230(g).
