Entries 101 through 120 cover August 3 to September 28, 2026. A minute order addressed the motion to withdraw as counsel for the plaintiff-in-interpleader (ECF 101). The plaintiff filed a request for judicial notice on ARB Gaming's motion to compel arbitration (ECF 102), addressed at ECF 104; additional counsel appeared for Affirm (ECF 103). On August 10 Affirm, ARB Gaming, Goldman Sachs and Apple filed replies on their motions to dismiss and to compel arbitration (ECF 105–108). His renewed request for judicial notice and to appear by Zoom (ECF 109) drew a minute order (ECF 110); a second gave notice regarding Affirm's motion to dismiss (ECF 111). He filed a supplemental declaration (ECF 112) and a motion for conditions on withdrawal and delivery of the client file (ECF 113), opposed by former counsel (ECF 114) and ruled on at ECF 116. ARB Gaming requested leave to file notice of an arbitration award (ECF 115); the Court gave the plaintiff-in-interpleader notice regarding her interpleader complaint (ECF 117); the plaintiff opposed the ECF 111 order (ECF 118); Apple designated new counsel for service (ECF 119). A minute order granted ARB Gaming's request and allowed the plaintiff a five-page supplemental brief (ECF 120).

MINUTE ORDER issued by Relief Courtroom Deputy for Magistrate Judge Chi Soo Kim on 8/3/2026: On July 21, 2026, Plaintiff-in-Interpleader Jamie Stahura filed a motion to withdraw as counsel. (ECF No. 88 .) The docket entry text states: "Motion Hearing set for 8/5/2026 at 10:00 AM in Bakersfield (CDB) before District Judge Daniel J. Calabretta." Id. On August 3, 2026, counsel for Plaintiff-in-Interpleader contacted the Court and stated that they had intended to notice a hearing on August 5, 2026 before Magistrate Judge Chi Soo Kim in Courtroom 25. However, Plaintiff-in-Interpleader's motion was not properly noticed for hearing before Judge Kim or noticed on a date designated for the Court's civil law and motion calendar, and counsel did not provide notice to the Court of their docketing error until two days before the intended hearing date. Accordingly, no hearing on Plaintiff-in-Interpleader's motion to withdraw has been set. The motion will be submitted for decision on the record and written briefing pursuant to Local Rule 230(g). The Court is providing notice to Plaintiff that it may sua sponte dismiss certain claims against Defendant Affirm, Inc., namely, (1) unfair business practices in violation of California Business & Professions Code § 17200 (Count Six); (2) unjust enrichment (Count Seven); (3) "payment processor liability" (Count Eleven); and (4) aiding and abetting (Count Twelve) for failure to state a claim pursuant to Federal Rule of Civil Procedure 12(b)(6), see Wong v. Bell, 642 F.2d 359, 362 (9th Cir. 1981), to the extent these claims against Defendant Affirm, Inc. are barred by California's public policy against judicial resolution of gambling-related claims. See In re Apple Inc. App Store Simulated Casino-Style Games Litig., 806 F. Supp. 3d 1015, 1034-35 (N.D. Cal. 2025), appeal docketed, No. 25-7917 (9th Cir. Dec. 17, 2025). Plaintiff will be afforded an opportunity to respond by submitting a written opposition within thirty (30) days from the date of this order. See Wong, 642 F.2d at 362. Plaintiff is warned that failure to file an opposition by the prescribed deadline may result in a recommendation that Plaintiff's claims be dismissed without leave to amend. Thereafter, the motion will be submitted for decision on the record and written briefing pursuant to Local Rule 230(g). On May 31, 2026, the Court granted Plaintiff's former counsel's motion to withdraw (ECF No. 47 ) and ordered outgoing counsel to serve a copy of the Court's order and file a certificate of service attesting to such service; and "[a]t such time as service is completed, attorneys Amina Mack's and Jacqueline Sale's responsibility to represent Plaintiff Matthew Thomas Joyce will be terminated." 5/31/26 Order (ECF No. 58). On July 3, 2026, Plaintiff's outgoing counsel filed the certificate of service of the Court's May 31, 2026 order. (ECF No. 84 .) Therefore, attorneys Amina Mack's and Jacqueline Sale's responsibility to represent Plaintiff has been discharged. To the extent Plaintiff claims he received an incomplete client file or that his former counsel engaged in improper conduct during their representation of Plaintiff, Plaintiff must work with his former counsel to resolve those disputes outside this action. Accordingly, Plaintiff's Motion (ECF No. 113 ) is DENIED, and the October 6, 2026 hearing on Plaintiff's Motion is hereby VACATED. IT IS SO ORDERED. MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Chi Soo Kim on 9/18/2026: The Court is providing notice to Plaintiff-in-Interpleader Jamie Stahura it may sua sponte dismiss Plaintiff-in-Interpleader's Interpleader Complaint (ECF No. 4 ) for failure to state a claim pursuant to Federal Rule of Civil Procedure 12(b)(6), see Wong v. Bell, 642 F.2d 359, 362 (9th Cir. 1981), because the Interpleader Complaint alleges claims that are not for interpleader nor in the nature of interpleader. See, e.g., Rubin v. United States, 2021 WL 5238577, at *3 (C.D. Cal. Feb. 23, 2021). The Court may also sua sponte dismiss the Interpleader Complaint for lack of subject-matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(h)(3), see Fiedler v. Clark, 714 F.2d 77, 78-79 (9th Cir. 1983), where (1) the Interpleader Complaint does not allege the Court has jurisdiction over an interpleader action brought under Federal Rule of Civil Procedure 22; and (2) the Interpleader Complaint does not allege facts to bring it within the ambit of the statutory interpleader provision, 28 U.S.C. § 1335. See, e.g., Pajarillo v. Schuler-Hintz, 2023 WL 2137409, at *3 (D. Nev. Feb. 17, 2023). Plaintiff-in-Interpleader Jamie Stahura will be afforded an opportunity to respond by submitting a written opposition within twenty-one (21) days from the date of this order. See Wong, 642 F.2d at 362.
